Labour and Love – Hire Terms & Conditions

These Terms & Conditions apply to all Labour and Love equipment hire. Part 1 covers our Birth Pool Hire and Part 2 covers our TENS Machine Hire. Please read the part that matches your booking — if you hire both, both parts apply. By placing a hire booking, you agree to the relevant terms below.

Part 1 — Birth Pool Hire

By placing a booking for a Labour and Love Birth Pool Hire Kit, you agree to the following terms and conditions.

1. About Our Hire Kits

Our birth pool hire kits are intended for personal, private use only during labour and birth. They are designed to support comfort during labour but are not medical devices and are not a substitute for professional medical advice or care.

2. Eligibility & Responsibility

  • The person placing the order must be 18 years or older.

  • You confirm that you have consulted with your midwife or healthcare provider and that water birth is appropriate for your circumstances.

  • Labour and Love is not responsible for any medical outcomes related to the use of the birth pool.

3. Hire Period

  • The hire period can range from 4 weeks to 5 weeks, unless otherwise agreed.

  • Hire periods begin from the dispatch or collection date, not the date of labour.

  • Late returns may incur an additional fee of $25 per day, subject to availability for future bookings.

4. Cleaning & Hygiene Requirements

For health and safety reasons, strict cleaning standards apply.

You agree to:

  • Follow the Cleaning & Care Guide provided via email after purchasing our hire kit.

  • Use a brand new, single-use pool liner for your birth.

  • Thoroughly clean, disinfect, dry, and repack all hire items before return.

⚠️ If hire items are returned unclean, a cleaning fee will be deducted from your $50 bond:

  • Light residue (hair, dust, surface marks): no charge — we take care of this as part of every return.

  • Requires re-sanitising (bodily fluids or staining on the pool body, or items returned damp): $25.

  • Significant (packed away wet, mould, set-in staining, or extensive sanitising required): $50.

The single-use liner is provided to contain birth fluids during use. Items soiled beyond the liner require full sanitising before rehire and are charged as above. If items are deemed unfit for rehire, replacement will be charged at cost and invoiced separately.

5. Damage, Loss & Replacement

You are responsible for the hire items from the time they are received until they are returned.

You may be charged for:

  • Damage beyond normal wear and tear

  • Missing items

  • Stains, mould, or water damage caused by improper drying

  • Punctures, tears, or misuse of the pool

Replacement costs will be charged at full retail value.

6. Proper Use

You agree to:

  • Use the birth pool indoors only, on a level surface.

  • Ensure the pool is never left unattended while filled.

  • Avoid overfilling or overheating the water.

  • Keep sharp objects, pets, heaters and any other hazards away from the pool.

  • Follow all setup and safety instructions provided.

Labour and Love accepts no responsibility for damage to flooring, furniture, or property caused by water leakage or incorrect setup.

7. Cancellations & Refunds

  • Cancellations made more than 14 days before hire start date are eligible for a refund, minus a $50 admin fee.

  • Cancellations within 14 days of the hire start date are non-refundable, as the kit is reserved exclusively for you.

  • If you do not end up using the pool, the hire fee is still payable.

8. Liability & Disclaimer

  • Labour and Love is not liable for injury, loss, or damage arising from the use or misuse of the birth pool hire kit.

  • Use of the hire kit is entirely at your own risk.

  • To the fullest extent permitted by New Zealand law, Labour and Love’s liability is limited to the hire fee paid.

9. Returns

  • All hire items must be returned by the agreed return date using the return method outlined in your hire instructions.

  • Items must be returned clean, dry, and fully packed.

  • Failure to return items may result in replacement charges.

10. Privacy

Your personal information is used solely for the purpose of managing your hire booking and is handled in accordance with our Privacy Policy.

11. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

12. Acceptance of Terms

By placing a booking with Labour and Love, you confirm that you have read, understood, and agree to these Hire Terms & Conditions.

Part 2 — TENS Machine Hire (“The Surge”)

By placing a booking for a Labour and Love TENS Machine Hire (TensCare Perfect mama+), you agree to the following terms and conditions.

1. About Our TENS Hire

Our TENS machines are hired for personal, private use only during labour and birth. A maternity TENS machine is a drug-free comfort aid, not a medical device, and is not a substitute for professional medical advice or care. It is designed for use in labour from around 37 weeks, or as advised by your midwife.

2. Eligibility & Responsibility

  • The person placing the order must be 18 years or older.

  • You confirm that you have consulted your midwife or healthcare provider and that using a TENS machine is appropriate for your circumstances.

  • Labour and Love is not responsible for any medical outcomes related to the use of the TENS machine.

3. Hire Period

  • The hire period is 4 or 5 weeks (choose at checkout), unless otherwise agreed.

  • You choose your start date from the booking calendar at checkout. We recommend a start date around 3 weeks before your due date, so the machine arrives in good time to practise and comfortably covers your due date.

  • Hire periods begin from the dispatch or collection date, not the date of labour.

  • Need it longer? Where availability allows, additional hire is $15 per full week, deducted from your bond — just let us know before your return date.

  • We currently hold one unit, so dates are booked on a first-come basis — please book early to secure your window.

4. What’s Included

Your hire includes the TensCare Perfect mama+ unit, 2 lead wires, a lanyard, a belt clip and storage pouch (all returned to us), plus — yours to keep — 4 brand-new electrode pads, 2 batteries in use and 2 spares, instructions and a Quick Start Guide, The Nest sample pack, and The Birth Partner’s Guide. A return postage label is included for sending the unit back.

5. Cleaning & Hygiene

  • Brand-new electrode pads are supplied for every hire; the unit and accessories are cleaned and sanitised between hires.

  • Please keep the unit dry and return it in a reasonably clean condition. Do not submerge the unit or use it in water.

6. Damage, Loss & Replacement

You are responsible for the hire items from the time they are received until they are returned. You may be charged for damage beyond normal wear and tear, missing items (leads, lanyard, belt clip or pouch), or water damage caused by use in a bath, shower or pool. Replacement costs are charged at full retail value, and any amount above the bond is invoiced separately.

7. Delivery & Returns

  • Delivery is by tracked courier at our standard rates — $8 urban / $13 rural (excluding oversized items) — chosen at checkout. Delivery is free when your TENS is bundled with a Birth Pool Hire, or on orders over $150.

  • A return postage label is included in your kit — pack the unit and accessories and drop it off or book a pickup by your return date. Keep the electrode pads, batteries, The Nest and The Birth Partner’s Guide — those are yours.

  • You are responsible for the unit until we receive it back; we recommend using the tracked return label provided.

8. Bond

A refundable $50 bond is charged when you book and refunded in full once the unit is returned by the due date, in full working order and with all accessories. We aim to refund within 7 days of checking the unit back in.

9. Proper Use

  • Use the unit only as intended and follow the instructions provided.

  • Never use the unit in water (bath, shower or pool) — remove it before getting into a birth pool.

  • Place the electrode pads as instructed, and begin use in early labour for best effect.

10. Cancellations & Refunds

  • Cancellations made more than 14 days before your hire start date are eligible for a refund, minus a $10 admin fee.

  • Cancellations within 14 days of the hire start date are non-refundable, as the unit is reserved exclusively for you. Your $50 bond remains refundable on return.

11. Shared Terms — Liability, Privacy, Governing Law & Acceptance

Sections 8 (Liability & Disclaimer), 10 (Privacy) and 11 (Governing Law) of Part 1 apply equally to TENS Machine Hire: use is entirely at your own risk, our liability is limited to the hire fee paid, your personal information is used solely to manage your booking, and these terms are governed by the laws of New Zealand.
